Every election campaign we hear of people getting bent out of shape because a particular candidate uses a song at a rally or event.
For example, a number of artists and their fans are very disturbed at Donald Trump using their songs. Here’s a legal fact: a political candidate can use whatever songs they choose at their rallies. The artists may be upset by this, but legally, there’s nothing they can do about it as long as these songs are played in venues that pay performance royalties. It’s no different than playing a song in a shopping mall or a grocery store. And since pretty much every venue capable of hosting a rally has to pay these performance fees, candidates can play whatever songs they choose.
However, the playing of these songs does NOT mean that the artist is endorsing that candidate. That’s a fine point that’s lost on some people.
