CONTEST RULES AND REGULATIONS
THE ULTIMATE EDGEFEST ’09 BACKSTAGE PASS


1. THE CONTEST AND THE CONTEST PERIOD

THE ULTIMATE EDGEFEST ’09 BACKSTAGE PASS contest (the “Contest”) commences at 12:00 a.m. on April 15, 2009 and concludes at 11:59 p.m. on April 26, 2009 (the “Contest Period”).

2. NO PURCHASE NECESSARY

3. ELIGIBILITY

The Contest is open to residents of Ontario, who are 19 years of age or older but excluding employees, directors and officers of, CFNY-FM, Corus Entertainment Inc. (“Corus”), any affiliate (as defined in the Canada Business Corporations Act) of CFNY-FM or Corus (the “Affiliates”) and each of their respective advertising and promotional agencies, contest judging organization, any provincial liquor authorities or liquor licensee authorized by it, or a member of the immediate family (defined as parents, siblings, children and spouse, regardless of where they live) or household (whether related or not) of any of the above persons.

4. HOW TO ENTER AND WIN

Complete the following steps during the Contest Period:

(a) If you aren’t already a member of ‘THE INSIDE EDGE”, log on to www.edge.ca (the “Website”) and become a registered member of “THE INSIDE EDGE” by filling in the information requested;

(b) Post a video on YouTube.com (see Video Requirements, below). Make note of your “embed code”; and

(c) Return to the Website, click on the “Submit Your Video” link, and post your video by entering the ‘embed code’ associated with your YouTube video.

On April 27, 2009, one entrant will be randomly selected, and contacted by phone, live, during the Dean Blundell Show and awarded the Grand Prize, as defined below. If the entrant selected is unavailable by telephone when contacted, he or she will be disqualified.

5. VIDEO REQUIREMENTS

Each video submitted must comply with the following requirements:

(a) Must be in English, must be no less than 45 seconds and no longer than 60 seconds;

(b) Must tell the story of worst concert experience and explaining why entrant should be chosen to win Contest.

(c) Must be comprised of wholly original material; and

(d) Must contain no musical content.

All videos will be reviewed before being posted on the Website. Entries will be disqualified if the entry form is not fully completed (including video upload) during the Contest Period, or if video does not conform to the Video Requirements. Contest judges reserve the right, in their sole discretion, to modify, edit or remove any Video, or to request an entrant modify or edit his or her video for any reason. All videos that are deemed appropriate will be posted at on the Website within 48 hours of submission for the duration of the Contest Period.

6. THE GRAND PRIZE

The Grand Prize includes:
• Two (2) tickets to Edgefest ‘09 on June 20, 2009, at Downsview Park, including “Fast Passes” to skip the entry line;
• Two (2) Edgefest ‘09 Backstage Passes including band “meet n’ greets” (bands TBD)
• Meals for two (2) at Edgefest ’09;
• (1) one digital camera (details TBD); and
• personal photographer for the day of Edgefest ‘09

7. THE GRAND PRIZE VALUE

The approximate retail value of the Grand Prize is $1,000.

8. VIDEO RIGHTS

By entering the Contest, each entrant grants to CFNY-FM and Corus (i) the non-exclusive right and license to publish, display, reproduce, modify, edit or otherwise use all videos submitted in connection with the Contest, in whole or in part, on the Website and/or for advertising or promoting the Contest, or for any other reason; (ii) permission to use hs or her name, address, voice, statements about the Contest and/or photograph or other likeness without further compensation, in any publicity or advertisement carried out by CFNY-FM or Corus, in any manner whatsoever, including print, broadcast or the Internet; and releases and holds harmless CFNY-FM and Corus and its advertising and promotion agencies, the Contest judges, and each of their respective agents, employees, directors, successors, and assigns, against any and all claims, injury or damage arising out of or in relating to participation in the Contest, and further against any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action.

9. REPRESENTATIONS AND WARRANTIES OF ENTRANTS

Each entrant represents and warrants that the video submitted by the entrant:
(a) is original to him/her and that the entrant has all necessary rights in and to the video and all of its components, including, without limitation, any and all images and photographs, to enter the video in the Contest;
(b) does not and will not violate any law, statute, ordinance or regulation;
(c) does not contain any third parties, unless consent has been obtained from all such individuals (no third parties under the age of majority in their province or territory of residence permitted) (click here to download the consent form that must be signed by each individual appearing in your Video);
(d) will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; and
(e) is not and will not be defamatory, trade libelous, pornographic or obscene, and further that it will not contain, include, discuss or involve, without limitation, and of the following:
• Obscenities;
• Nudity;
• Explicit, graphic or excessive sexual activity;
• Crude, vulgar or offensive language and/or symbols;
• Derogatory characterizations of any ethnic, racial, sexual or religious groups;
• Content that endorses, condones or discussed any illegal or inappropriate activity, behaviour or conduct;
• Personal information of individuals, including without limitation, names, addresses (physical or e-mail), phone and/or fax numbers;
• Conduct or other activities in violation of these Contest Rules and Regulations;
• Any identifiable third party products and/or trade-marks, brands, logos or endorsements (other than products). For example, any clothing worn in the Video must mot contain any visible logos, trademarks or other third party materials;
• URLs or links to any websites; and
• Any other content that is or could be considered inappropriate, unsuitable or offensive, as determined by the Sponsor and/or the contest judges in their sole discretion.

10. VIDEO TO COMPLY WITH RULES

CFNY-FM and Corus reserve the right to disqualify from the Contest any video that is deemed, in their sole discretion, to violate the terms and conditions set forth in these Contest Rules. By submitting a video, the entrant agrees that the Video complies with all conditions stated in these Contest Rules.

11. DEADLINE FOR CLAIMING GRAND PRIZE

The Grand Prize winner must claim the Grand Prize by 5:00 p.m. on May 11, 2009 (the “Deadline”). If the Grand Prize winner fails either to claim the Grand Prize or inform CFNY-FM of his or her inability to claim the Grand Prize before the Deadline, his or her entry will be forfeited and another eligible entrant will be selected.

12. EXPENSES

The Grand Prize winner is responsible for all incidental expenses incurred in connection with accepting the Grand Prize, including, but not limited to transportation to and from the concert (the “Expenses”). The Grand Prize winner understands that he or she may not seek reimbursement for the Expenses from CFNY-FM, Corus, the Affiliates, or their respective advertising and promotional agencies.

13. LIMITATION ON NUMBER OF ENTRIES PERMITTED

Multiple entries are permitted. Entries are subject to verification and will be declared invalid if they are reproduced, falsified, altered or tampered with in any way. Each video submitted during the Contest Period will count as one entry, provided it complies with these Contest Rules and Regulations.

14. CHANCES OF WINNING

Chances of winning depend on the total number of entries received during the Contest Period.

15. NO REPRESENTATIONS OR WARRANTIES

Neither CFNY-FM nor Corus makes any representation or offers any warranty, express or implied, as to the quality or fitness of the Grand Prize. The Grand Prize winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from CFNY-FM or Corus should the Grand Prize fail to be fit for its purpose or is in any way unsatisfactory to the Grand Prize winner.

16. DECLARATION AND RELEASE OF GRAND PRIZE WINNER

Before being awarded the Grand Prize, the Grand Prize winner must:

a) Correctly answer, unaided, a time-limited skill-testing mathematical question; and

b) Sign a standard form confirming that by entering the Contest:

• he or she read, understood and accepted these rules and regulations;

• that he or she understands that acceptance of the Grand Prize may involve danger and/or exposure to risks and hazards of both man-made and natural origin, whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, he or she may suffer damage to personal property, serious personal injury, illness or even death;

• that he or she nevertheless freely and voluntarily agrees and does hereby assume any and all risks of personal injury, illness, death arising out of or connected with his or her participation in the Contest and winning the Grand Prize; and

• that he or she releases CFNY-FM, Corus, the Affiliates, and all of their directors, officers, employees, agents as well as their respective advertising and promotional agencies (collectively, the “Releasees”) from any and all liability arising in connection with participation in the Contest and acceptance of the Grand Prize, including, without limitation, any financial, legal or moral responsibility or loss or personal injury including death or damage to or loss of property suffered or incurred or arising from participating in the Contest or accepting the Grand Prize, whether suffered by the Grand Prize winner, or by his or her heirs, administrators, personal representatives or executors, and notwithstanding that such injuries or losses may have been caused solely or partly by any act, omission, negligence or gross negligence of any or all of the Releasees.

17. GRAND PRIZE TO BE ACCEPTED AS AWARDED

The decision of the Contest judges is final, and the Grand Prize must be accepted as awarded. No portion of the Grand Prize is transferable. The Grand Prize is not redeemable for cash and no substitute for any portion of the Grand Prize is offered. Should the Grand Prize winner be unable to claim the Grand Prize as awarded, his or her entry will be forfeited and another eligible Contest participant will be selected.

18. SUBSTITUTION OR CHANGE TO THE CONTEST

CFNY-FM, Corus, and their respective advertising and promotional agencies reserve the right to substitute the Grand Prize or any component thereof, for those of approximately the same value and reserve the right to change the Contest rules or terminate or withdraw the Contest at any time, without prior notice.

19. OWNERSHIP OF ENTRIES

All entries shall become the property of CFNY-FM, Corus and their advertising and promotional agencies. The Releasees assume no responsibility for lost, stolen, destroyed or otherwise indecipherable entries due to any failure or technical malfunction of the telephone network, on-line computer systems of equipment, servers, access providers, software, poor reception, technical problems, failure of any email or submission or due to any other reason regardless of cause.

20. CONSENT TO USE OF PERSONALITY

By entering the Contest, each entrant, including the Grand Prize winner consents to the use of his or her name, city of residence, photograph, voice, likeness, image or any other aspect of his or her personality for any publicity and programming purposes, commercial or otherwise, in all media used by CFNY-FM and Corus, promoters and their advertising and promotional agencies, without any payment or compensation. The Grand Prize winner further agrees that his or her audio reaction may be used for on-air promotional purposes. The entrants understand and acknowledge that CFNY-FM may contact him or her on-air without prior knowledge as a result of his or her participation in the Contest.

21. CONSENT TO COLLECTION AND USE OF PERSONAL INFORMATION

By entering the Contest and voluntarily providing personal information including, but not limited to, name, address, city, email address, home and office telephone numbers (the “Registrant Information”), each Contest entrant grants permission to CFNY-FM and Corus to the collection and use of the Registrant Information for the exclusive purpose of administering the Contest and selecting the Grand Prize winner(s). No correspondence will take place between CFNY-FM, Corus and the entrants except in connection with the Contest and, in the case of the Grand Prize winner, as a result of entering the Contest and winning the Grand Prize.

22. NO DISRUPTION TO CONTEST

All Contest entrants agree to respect the entry process and the operation of the Contest as outlined in these rules and regulations. CFNY-FM or Corus may disqualify or ban from future contests any Contest entrant or person who CFNY-FM or Corus believes is tampering with the entry process or the operation of the Contest, to be acting in a disruptive or unsportsmanlike manner, or behaving with the intent to annoy, abuse, threaten or harass any person associated with CFNY-FM or Corus. Any attempt to deliberately damage a website or to undermine the legitimate operation of a contest is a violation of criminal and civil laws, and should any such attempt be made by a Contest entrant or other person, CFNY-FM and Corus may seek damages or other relief from such Contest entrant or other person to the fullest extent permitted by law.

24. COMPLIANCE WITH CONTEST RULES

All contestants agree to abide by the Contest Rules, which are subject to change at the sole discretion of CFNY-FM and Corus.

25. COMPLIANCE WITH LAWS

This Contest is void where prohibited by law and is subject to all federal, provincial, territorial and municipal laws and regulations of Canada and of each province, territory and municipality of Canada, respectively.
